Terms and conditions of your stay

The accommodation provider  “Stay in Cupar” provides short stay holiday accommodation and compliance with the booking conditions gives the booked guests a “licence to occupy” for those dates. This is not a Private Rental Tenancy and is not permanent tenancy.

BOOKINGS:

Can be made on-line or by direct contact with Stay In Cupar. You will receive email confirmation of your booking. Bookings may be extended but may not total periods exceeding maximum 4 months. (For example, someone working in area needing accommodation, going home on time off to their permanent home elsewhere. We may, by arrangement, store items you don’t wish to transport home during your stay/ home trips, eg bikes, work equipment)  The person held responsible for the guests will be the person who made the booking (the booker).

The receipt of an on-line booking and a deposit of full payment are deemed to be a firm booking. Bookings are not confirmed until payment of the deposit or full payment are received and cleared. Bookings may be added to and this additional period is classed as a separate booking.  For example, where builder works are behind schedule and guests cannot return to own home on date originally booked, or where a short term work contract has been extended, we may require you to move to another  Stay in Cupar accommodation.

Full payment of the remaining balance of the initial deposit is required 14 days before the date of entry. If any additional separate booking is required, this would need to be paid in full and cleared before commencement of additional period.

If a booking is cancelled within 14 days of the date of arrival, the booker will remain liable for payment of the full cost of the holiday. Upon receipt of written confirmation (this includes email) of the cancellation from the booker, Stay in Cupar will endeavour to re let the property and if successful; will make a refund to the booker, less the deposit which is non-refundable.

 

IMPORTANT  Short Term Lets New Scottish Licence Requirements- What this means for Guests

From 1 October 2023 it is illegal for Short Term accommodation providers including B&B’s, AirBnB, home sharers and self catered to take guests without  having applied for a licence by that date. Stay in Cupar has applied for STL licences for each of the 4 Short Term Accommodations Bee’s Townhouse, Castlefield Cosy Cottage, Moatville Lower & Upper and is now waiting on licences being issued. Fife Council now has 12 months ( potentially longer if Government allows extension) to determine each application. 

Although Stay In Cupar has been operating for more than a decade as self catered and B&B / homeshare for nearly 20 years before that, this does not automatically mean licences will be approved. If licences are not granted then any bookings beyond the date of determination cannot go ahead. If it is the case that one accommodation is not approved we will endeavour to accommodate guests in other Stay in Cupar accommodations. If we do not have any accommodations available, by law we must cancel your booking. This is the situation across Scotland. We understand the frustration and uncertainty this causes- to both guests and ourselves. 

Where guests have paid deposits or in full and we cannot, under this legislation, accommodate you we will refund all monies paid  within 7 working days of Stay in Cupar being notified of licence/s not being approved. Refunds will be made by bank transfer  and we will contact guests for bank account/ secure links for refund. Stay in Cupar is not liable for any other costs or compensations for this situation which is outwith our control.

 

 

Covid -19:  (Clause left in, although as at 1 Oct 2023 Stay in Cupar doesn’t not envisage future restrictions on travel)

If Covid -19 restrictions prevent you from being able to travel either from your current address or into Fife  we will allow the booker to postpone the stay to another date and be taken before end of 2022. The stay may be transferred to another person by written agreement. There may be an increase in rate. Postponed stay will require to be taken within 6 months of original dates.

Any deposit and/or full payment will be carried forward and may be used for any of Stay in Cupar accommodations, subject to availability, and can be transferred to another person.

Travel insurance to cover your booking in event of illness is highly recommended.

PAYMENTS:

BACS payments are safest, please use either surname or booking number as reference.

BACS details will be on booking form. Bank details will be in name “Stay in Cupar”.

ARRIVAL/DEPARTURE:

Your stay (“licence to occupy”) commences, unless otherwise notified, at 4pm on the day of arrival and terminates at 10am on the day of departure to allow the changeover to commence. Late departure up to midday will result in a £50 per hour surcharge and an hourly surcharge of £100 thereafter.

EXTRA GUESTS:

At the time of booking the total of number of guests will be required.

If, for example you have booked for two guests and wish other guests to join you for part or all of stay you must notify us by email before they stay. This is to ensure new licence conditions and  insurance is complied with and that there is sufficient linen. There may be supplementary charge for additional guests.

The number of people occupying must not exceed the maximum occupancy level stated in the property details. Owners reserve the right to terminate the occupancy of the property without notice or a refund in the case of a breach of this condition.

The use of any amenities where offered is entirely at the users risk and no responsibility can be accepted by Stay in Cupar for any death or personal injury (save to the extent that such death or personal injury was caused by the negligence of the property owner).

No liability for any other loss or damage with the use of such amenities is accepted.

HOUSEKEEPING:

The booker is responsible for the condition of the property and its entire contents during the stay period, fair wear and tear is accepted. The booker will make good any damage or loss and leave the property and contents in a clean and tidy condition. Where damage occurs, Stay in Cupar can arrange replacement/ repairs on behalf of booker but booker remains responsible for costs. (In many cases we have spare glasses/ crockery so to avoid unnecessary guest expenditure we ask that guests notify us of breakages). We accept that occasional spills happen and ask that you notify us as soon as possible so we can use correct cleaning products and treat any stains as soon as possible. We use a professional cleaning company and knowing what spillages are, really assists them with  deep cleaning thereby preventing damage and staining.

Smoking, including vaping & e-cigs, is prohibited inside properties and garden summerhouses.

Stay in Cupar reserves the right to make a charge for extra cleaning if the property including garden, is not left in a satisfactory condition.

PROBLEMS:

Stay in Cupar really wants you to enjoy your stay and every effort has been made to ensure this. However, in the unlikely event of dissatisfaction with the property or any subsequent problem, the booker must immediately contact us so that the opportunity to rectify the problem is given. Sometimes issues completely outwith our control happen and we will do everything reasonable to minimise impact, for example by moving you to alternate Stay in Cupar accommodation, if available or refunding balance of stay.

GUEST SAFETY AND SECURITY:

Please look after yourself and your effects during your stay. Be aware of Scottish legislation in terms of alcohol “drinking and driving” and speed limits.

Guests should ensure that their own travel insurance covers personal effects particularly of high value items such as cameras, laptops, golf equipment and ensure that they take appropriate security steps including locking doors and keeping items out of sight. If there is any reason for access to your booked accommodation during your stay, unless in extreme circumstances, we will endeavour to make such access arrangements with the booker. If you have booked daily or mid stay cleans we will arrange access times directly with booker.

We do not permit temporary HOT TUBS or FIRE PITS  or POP UP BARS or INFLATABLES or similar as these create Health & Safety liabilities not covered by our insurers and may also be in breach of our licence conditions.

TERMINATION:

Stay in Cupar reserves the right to terminate this agreement and request the immediate departure of all people from the property in the event of a serious breach in the terms of this agreement. The breach may include but is not limited to the following events:

  1. Serious damage to the property
  2. A criminal or illegal act
  3. Unreasonable or abusive behaviour or
  4. Excessive noise which would adversely affect the rights of Stay in Cupar to be able to continue to operate the property for short lettings or involve authorities or police in any form of complaint or investigation.
  5. Smoking inside the property, additionally a £150 intense cleaning charge will be incurred.
  6. Leaving dog/s unattended unless suitably caged and calm.

CONTRACTUAL:

This contract is between the booker and Stay in Cupar, in terms of Schedule 4, section 8 of the Housing Act (Scotland) Act 1988 and confers on the booker the right to occupy the property for the period agreed for holiday purposes only. Where the booker is working away from home this is generally considered as “holiday” as the accommodation is only a temporary base, with booker having permanent residency elsewhere.

DATA PROTECTION:

The booker’s details may be passed on for accounting purposes or where Stay in Cupar is legally required to provide this data to a relevant statutory body. Your personal information will never be sold or otherwise passed to any 3rd Parties.

Personal note.

In a perfect world I would prefer not to have to list such terms and conditions but unfortunately since starting business in 2006 I have experienced a wide variety of people, a small number of whom necessitate strict terms and conditions.

Please don’t become a N/A  ( Politely in the trade we refer to bad guests as No Availability but it really means NEVER AGAIN.
